Terms of Service

By accessing or using Kona ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Kona reserves the right to modify these Terms at any time. Continued use of the Service following any changes constitutes acceptance of the modified Terms.

Kona is a cashback rewards platform that enables users ("Members") to earn cashback on qualifying purchases made through our affiliate tracking links at participating merchants. Cashback earned can be withdrawn through various payout methods including PayPal, Venmo, ACH bank transfer, gift cards, and USDC cryptocurrency.

You must be at least 18 years old and a legal resident of the United States to use Kona. By creating an account, you represent that you meet these requirements. Each individual is limited to one account. Creating multiple accounts is prohibited and may result in termination of all accounts and forfeiture of earned cashback.

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access to your account.

Cashback rates are set by our merchant partners and are subject to change at any time without notice. Cashback is earned only on qualifying purchases made through valid Kona tracking links. The following may result in cashback not being tracked or credited:

Using ad-blocking software, other coupon or cashback browser extensions, or VPNs that interfere with tracking; clearing cookies between clicking a Kona link and completing a purchase; making returns, cancellations, or chargebacks on purchases; purchasing excluded product categories as specified by the merchant; violating the merchant's terms of sale.

Cashback typically appears as "pending" within 1-3 days of a qualifying purchase and moves to "confirmed" after the merchant's return window (usually 30-60 days). Kona is not responsible for tracking failures caused by merchant systems or third-party interference.

Confirmed cashback may be withdrawn through the following methods: PayPal (minimum $5.00), Venmo (minimum $5.00), ACH bank transfer (minimum $5.00), gift cards (minimum $5.00), or USDC cryptocurrency via Coinbase, MetaMask, or WalletConnect (minimum $1.00).

All withdrawals are processed free of charge. For USDC withdrawals, Kona covers network gas fees. Processing times vary by method: USDC transfers typically complete within 1 minute; PayPal and Venmo within 1-3 business days; ACH transfers within 1-3 business days; gift cards are delivered instantly via email.

Kona reserves the right to delay or refuse withdrawals if fraudulent activity is suspected. Gift card bonus rates are promotional and subject to change.

USDC payouts are sent on the Base network (an Ethereum Layer 2 network). By requesting a USDC payout, you acknowledge that you understand how cryptocurrency wallets work and that you are providing a valid wallet address. Kona is not responsible for USDC sent to incorrect wallet addresses. Cryptocurrency transactions are irreversible.

USDC is a stablecoin pegged to the US dollar. Kona does not provide investment advice and makes no guarantees about the future value or stability of any cryptocurrency, including USDC.

You agree not to: create multiple accounts; use the Service for fraudulent purposes; manipulate or abuse the cashback system; use bots, scripts, or automated tools to interact with the Service; attempt to earn cashback on purchases you intend to return; share your account with others; resell or commercially exploit your cashback earnings in ways that violate merchant terms; or interfere with the proper functioning of the Service.

Violation of these terms may result in account suspension, termination, and forfeiture of all pending and confirmed cashback.

All content, trademarks, and intellectual property on the Service are owned by Kona or its licensors. You may not copy, reproduce, distribute, or create derivative works from any content on the Service without prior written permission.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Kona does not guarantee that cashback will be earned on every purchase, that the Service will be uninterrupted or error-free, or that cashback rates will remain constant. Merchant offers, cashback rates, and gift card bonus rates are subject to change at any time.

To the maximum extent permitted by law, Kona shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of cashback, loss of data, or loss of cryptocurrency. Our total liability shall not exceed the amount of confirmed cashback in your account at the time of the claim.

Kona reserves the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may close your account at any time through the Settings page. Upon termination, any pending cashback will be forfeited. You should withdraw confirmed cashback before closing your account.

These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
